1. Scope

 

For all deliveries by Mag. Thomas Schönthaler, Glacier Games (hereinafter referred to as GG) to customers, these General Terms and Conditions apply exclusively (hereinafter abbreviated GTC).

 

2. PURCHASE AGREEMENT

3. OFFER, ORDER AND CONCLUSION OF CONTRACT

 

All offers are non-binding and free of charge. The presentation of the products in the online shop does not constitute a legally binding offer. All offers are valid "while stocks last". In the event of price, inventory or calculation errors or errors, GG reserves the right to correct at any time.

We are not liable for any country-specific and / or system-related incompatibility.

The order is made via the internet via the pre-made order form. By clicking on the "Submit order" button in the last step of the ordering process, the customer makes a binding order for the goods contained in the shopping cart. Upon receipt of the order, an automated e-mail will be sent to the customer confirming the receipt of the order and serving only to inform the customer. With the order, the customer accepts these terms and conditions. The purchase contract is only concluded when GG expressly accepts the customer's order by sending an order confirmation in text form (e-mail, letter, fax).

GG expressly reserves the right not to accept orders without stating reasons. If GG rejects an incoming contract offer (order), this will be communicated to the customer in writing by e-mail.

 

4. YOUTH PROTECTION

 

In each item description is an exact age recommendation by the respective labeling system. The markings of these systems give a reliable indication of whether the game is suitable for an age group according to aspects of youth protection or not. Games marked "16+" and "18+" may contain extreme violence, a constrictive atmosphere or a harsh language and are thus in no way suitable for children and in the case of "18+" for teens. Due to this the customer has to indicate his age during the registration. By registering and thus placing an order, the customer confirms that he has reached the legal minimum age required for the purchase of the goods. If an order of the above-mentioned article takes place via the "guest" option, the customer has to confirm his legal age immediately upon request by GG by sending a light badge. This is obsolete with the payment method with "Paypal". The customer also bears the responsibility that the recipient has reached the legal minimum age when receiving the goods. Liability of GG in the event of non-compliance with these provisions is excluded. Liability for underage customers and recipients shall be borne by the legal guardian.

Any costs for return shipping, packaging material and labor, are borne by the person responsible.

 

5. DELIVERY AND DELIVERY TIME

 

a delivery takes place after receipt of payment within the deadline indicated to the customer on-line, however at least within the legal delivery period of 30 days starting from the order. Delivery is by post, rail or freight forwarder as letter or parcel shipment. If the customer is not present at the time of delivery, according to the conditions of the individual shipping companies the product will be delivered again on the next working day or deposited in a parcel shop, a post office. If the customer fails to pick up the goods in a timely manner (5 working days post, 6 days DPD), the consignment will be returned to GG. The resulting return costs are borne by the customer.

Withdrawal due to delay is only permitted after expiry of these 30 days.

The delivery status displayed on the website applies exclusively to Austria.

 

For pre-orders, the following information applies:

 

2 weeks before the appearance of a game, console or accessory, the amount to be paid should be returned to our account, otherwise no on-time delivery can be guaranteed. Furthermore, a free cancellation is possible only 2 weeks before the appearance of the game, console or accessory, if the cancellation takes place within 2 weeks before the publication date, there will be a cancellation fee of 3.5 Euro.

Our general terms of payment apply

We can not guarantee delivery dates for the day of publication (for imports - US & EU), as our suppliers may take several days to deliver items - however, we endeavor to deliver each individual customer as quickly as possible.

Normally, the article should arrive no more than 5 working days after the publication date.

 

Pre-order Price Guarantee:

 

The item will be delivered at the price of the order if the price is possible on the day of publication by the supplier. Furthermore, we offer the customer that the article, if it is cheaper by the date of publication, in the price is adjusted accordingly. (no cash payment - voucher will be issued)

Items with the wrong price will remain unaffected by the pre-order price guarantee.

This is a voluntary service from us!

 

6. SHIPPING

 

The customer is obligated to inspect the delivered goods immediately for obvious transport damages and to inform the post office, the railway or the carrier about the takeover. If the customer defaults in accepting the delivered goods or if he refuses to accept the delivery, the customer is obliged to compensate GG.

GG is entitled to either insist on acceptance of the delivery or to demand a reasonable compensation for the resulting expenses (eg transport costs).

 

7. RIGHT OF WITHDRAWAL

In order to maintain the cancellation period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

 

Consequences of the cancellation

If you withdraw from this contract, we will give you all payments we receive from you

including delivery costs (except for the additional costs incurred

8. PRICES AND SHIPPING COSTS

 

The prices quoted on the product pages include the statutory Austrian sales tax of 20.00% excluding shipping costs. The prices are valid until further notice.

The shipping costs depend on the quantity of goods ordered and the shipping method and are clearly communicated to the customer before submitting the binding order. These also include the statutory Austrian sales tax of 20%. Should export or import duties be due in the course of shipment, these are also at the expense of the customer. If you want to order tax-free as an entrepreneur on an intra-Community basis, the announcement of your VAT ID is essential. After successful examination, we can deliver tax-free to you.

 

9. PAYMENT AND ACCOUNTING

 

The purchase price is due immediately upon confirmation of the order and without any deductions. The order must be paid in full within 5 working days, otherwise there will be a cancellation (pre-order item except 2 weeks before publication). The prices are gross including VAT.

Payment can be made either by cash payment, advance payment, Sofortüberweisung or PayPal. GG names the bank details in the order confirmation and delivers the goods after receipt of payment.

After the order and payment process, the customer will automatically receive an invoice by e-mail. This invoice does not contain a digital signature and therefore does not entitle customers to deduct input tax. Upon request, an original invoice will be sent by post.

In case of default, default interest of 10% will be charged.

The customer undertakes to bear all costs and expenses associated with the collection of the claim, in particular collection charges or other costs necessary for an appropriate legal action.

The customer is not entitled to set off own claims against claims of GG. A right of retention of the customer is excluded.

All deliveries are subject to retention of title and thus remain the property of GG until full payment.

 

10. WARRANTY

 

The legally guaranteed warranty obligation applies.

GG assumes no warranty for defects for which it is not responsible, in particular as a result of:

- improper operation by the customer or third parties;

- force majeure, natural disasters, water damage, fire, etc .;

-Change of the installed software by the customer or third parties;

-significant deviations in item features (color, dimension, etc);

- Failure to observe instructions for use of the delivered product.

The assignment of warranty claims is excluded.

 

11. LIABILITY

 

GG and its employees are liable within the scope of the statutory provisions only for damages, provided that intent or gross negligence can be proven. Liability for slight negligence is excluded. The injured party has to prove the existence of gross negligence.

12. COPYRIGHT

 

The customer acknowledges that the software products distributed by GG enjoy copyright protection. Any duplication, distribution and other use of this product beyond its own private use is expressly prohibited to the customer.

Software products may only be used within the scope of the licenses granted by the manufacturer. Software may only be duplicated, processed and decompiled within the scope of the provisions of §§ 40d and 40e UhrG. Limits of the intended use of the software specified by the manufacturer are to be observed in each case.

 

14. APPLICABLE LAW, PLACE OF FULFILLMENT AND JURISDICTION

 

The legal relationships between GG and the customer are governed exclusively by Austrian law, excluding international referral standards. The provisions of the UN Sales Convention do not apply.

The place of performance for all mutual obligations arising from the respective business relationship is the registered office of GG, 6020 Innsbruck, Austria

The place of jurisdiction for all disputes arising between Clacier Games and the customer shall be - insofar as no compelling statutory provisions preclude - the locally and objectively competent Austrian court having jurisdiction for the registered office of GG. Provincial Court 6020 Innsbruck.

 

15. FINAL PROVISIONS

 

GG is entitled at any time to amend or supplement the General Terms and Conditions. Previously received orders will be processed according to the then still valid old terms and conditions.

All ancillary agreements, changes or additions to these terms and conditions must be in writing to be valid. The same applies to a departure from the requirement of written form.

Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions of the contract. In place of the non-legally effective provisions, such provisions that come closest to the economic purpose of the invalid provisions shall apply. The same also applies to regulatory gaps.
